Federal Labor Court ruling: Blanket exemption clause invalid

In today's modern workplace, increasingly characterized by mobility and global competition for talent, the process following a resignation often seems routine: the desk is cleared, access to the server is blocked, and the employee is sent home with continued pay until the end of the notice period. However, behind this apparent standard procedure lies a profound legal conflict, one that has enormous implications, particularly for highly qualified workers from abroad. When a skilled worker from a third country comes to Germany, it's about far more than just a salary; it's about professional identity, maintaining their qualifications, and often their legal status with the immigration authorities . A recent ruling by the Federal Labor Court (BAG, March 25, 2026 – 5 AZR 108/25) is now shaking up the previous practice of blanket leave of absence and significantly strengthening employee rights.


The myth of automatic exemption

Until now, many employers were under the impression that a simple clause in the employment contract was sufficient to immediately dismiss unwanted employees after they resigned. In the case decided by the Federal Labor Court (BAG), a field service employee had resigned, whereupon the employer immediately suspended him, invoking a standard clause. In our firm, we repeatedly observe that international experts, in particular, perceive such measures as a form of discrimination or an unfair obstacle to their future careers. The BAG has now clarified that such an "automatic suspension" is not legally valid. A blanket clause that allows for suspension without any consideration of the interests involved unfairly disadvantages the employee under Section 307 Paragraph 1 Sentence 1 of the German Civil Code (BGB) .


The right to work as a personal right

Why is this decision so groundbreaking? The court emphasizes that the interest in actual employment is constitutionally protected by the general right to privacy. Experts who come to Germany with a work visa want and need to use their skills. A forced break lasting several months not only damages their professional expertise but can also hinder integration. We expressly welcome this decision, as it counteracts the tendency to treat highly qualified workers as mere pawns. The right to employment generally exists until the last day of the employment relationship, unless the employer can demonstrate overriding interests justifying a release from work.


Consequences for residency status and life planning

For our clients, who have often gone through complex procedures at the State Office for Immigration (LEA) , many other factors depend on their employment. An unjustified suspension can raise questions when it comes to extending a residence permit or when a complete record of employment is required for the next career step. Furthermore, suspension is often linked to the withdrawal of company resources such as a company car. However, if the suspension is invalid, the basis for withdrawing these resources usually also disappears. Anyone paying rent for a high-quality apartment in Berlin depends on the contractually guaranteed benefits. The ruling mandates an individual assessment in this case, prioritizing the protection of the individual over the convenience of the HR department.


When a leave of absence remains permissible

Despite the ruling, the practice of suspending employees from work is not entirely eliminated. However, it now requires a sound justification. We advise both employers and employees to carefully examine the specific reasons . A suspension may be justified if the protection of trade secrets is at risk or if a concrete conflict of competition is imminent. But: A mere "We want it this way" is no longer sufficient. Health insurance and other social benefits must also remain unaffected during this period. Should the employer deny access to the workplace without having conducted such a balancing of interests, this could even lead to legal proceedings in which the employee would sue for actual employment.


Conclusion: A victory for the rights of skilled workers

The Federal Labor Court's ruling sends a clear signal against legal simplification at the expense of employees. It strengthens the position of skilled workers , who are so essential to Germany's economic competitiveness. A leave of absence is no longer a unilateral dictate by the employer, but requires transparent communication and a factual justification. This not only promotes legal certainty, but also respectful treatment during a period that is already fraught with uncertainty for many regarding their passport status or future plans.
