Hesse launches accelerated skilled worker procedure

The global competition for the brightest minds leaves no room for inertia. While highly qualified talent worldwide weighs their options, in Germany, success often hinged not on qualifications, but on the employer's postal code. This was particularly noticeable in Hesse: those who were employed as Skilled workers seeking to come to the economically strong state of Hesse encountered a fragmented bureaucratic landscape that often presented more of a hindrance than a help. But now there's a change that could permanently transform Hesse as a business location. Starting in autumn 2026, Hesse will finally introduce a Central Office for Skilled Immigration Hesse (ZFEH) . What has been a long time coming will hopefully finally turn out well – because Hesse was the last of the western German states to take this necessary step.

Finally in the fast lane: The introduction of the "Fast Lane"

In political discourse, the new model is often referred to as the "Fast Lane." As a law firm, we view this terminology with a mixture of relief and professional skepticism. Internationally, the term "Fast Track" has become established for accelerated procedures. It is almost characteristic of German bureaucracy that we want to pursue our own linguistic peculiarities, even when it comes to internationalization. But beyond the terminology, the content is crucial: The Central Office for Equal Opportunities (ZFEH) at the Darmstadt Regional Council is intended to end the existing fragmentation. Previously , 31 different local authorities had sometimes significantly divergent processes, which often led to unforeseen delays for internationally mobile talent.

The pooling of expertise is a reaction to the massive Skilled immigration , the numbers of which have increased by over 1000 percent in Hesse alone between 2020 and 2025, is a significant factor. If a company wants to hire a highly qualified worker today, this is a major consideration. Visas are often the bottleneck. The accelerated procedure under Section 81a of the Residence Act is now being made the central control instrument by the Central Office for Foreigners' Affairs (ZFEH). We expressly welcome this progress, but strongly criticize the fact that Hesse allowed so much time to pass, while neighboring states like Baden-Württemberg have had functioning structures in place for years.

Legal certainty through clear deadlines according to § 81a of the Residence Act

The greatest advantage of the new central office lies in the planning certainty it provides . The accelerated procedure is not a vague promise, but is bound by legal deadlines. As soon as the employer submits a power of attorney from the specialist, the The immigration office concludes an agreement with the company. The office must then (theoretically) assess the equivalence of the foreign qualification within strictly defined timeframes and obtain approval from the Federal Employment Agency. For those affected, this means that the path to... The residency permit process no longer ends in uncertainty. While the ZFEH can streamline internal German procedures, the quality of the documents and the applicants' preparation remain the responsibility of those involved.

Conclusion: A necessary but belated milestone

The establishment of the Central Office for Foreign and Skilled Immigrants (ZFEH) in Hesse sends a long-overdue signal to the international business community and skilled immigrants. Pooling expertise in one central location will reduce errors and increase efficiency. We welcome the implementation of Section 81a of the Residence Act by a specialized agency , but caution that this can only be the beginning of a comprehensive reform of migration administration. The "fast lane" must not remain a mere marketing gimmick, but must be supported by sufficient staffing and digital interfaces. Only if the procedures are reliably completed within the set deadlines will Hesse gain ground in the competition for business locations.
