Germany signs social security agreement (SSA) with Colombia

On July 30, 2026, Germany and Colombia signed a new social security agreement in Berlin . It was signed by the Colombian Ambassador Yadir Salazar Mejía, the State Secretary at the Federal Ministry of Labor and Social Affairs, Lilian Tschan, and Dr. Wiebke Rückert from the Federal Foreign Office. What at first glance sounds like a diplomatic administrative act has far-reaching consequences for thousands of Colombians. Skilled workers , their employers and their Families in Germany face very concrete financial consequences – especially regarding retirement savings. Those who commute between the two countries for work or relocate permanently should now understand what is changing and where potential pitfalls still lie.

What exactly does the new social security agreement regulate?

The agreement coordinates the pension insurance systems of Germany and Colombia in cases where insured persons live or work in the other contracting state. It is based on the same principles that also apply within the The EU-wide system applies and pursues two central objectives: First, employees who are only temporarily employed in another country should be able to remain in the social security system of their previous country of employment. Second, insurance periods from both countries are aggregated, making it easier to fulfill the waiting periods for pension entitlement. The pension itself is then calculated only on the basis of the periods actually completed in the respective country, but is also paid in full abroad. Legally, this principle can be compared to the regulations on the transfer of pension entitlements in and out of the EU in German social security law (§§ 4, 5 SGB IV) and with the export of pensions according to §§ 110, 113 SGB VI, which so far only apply within the EU. EU and vis-à-vis states with existing social security agreements in this form.

Why Colombia in particular – and why now?

The selection is no coincidence. Colombia is among the countries the German government considers a top priority for recruiting skilled workers from third countries . Well-trained Colombian engineers, nurses, IT specialists and doctors are in demand in Germany, but concerns about double social security contributions or lost pension entitlements have so far deterred many potential applicants and their employers. This agreement aims to eliminate precisely this uncertainty and... Making skilled worker immigration from Colombia more attractive – one building block alongside instruments such as the EU Blue Card and the Opportunity map that already facilitates the influx of qualified workers.

When will the agreement actually come into force?

One point that is often overlooked in public reporting is that signing the agreement does not automatically mean it enters into force. As an international treaty affecting the rights and obligations of citizens, the agreement requires, according to Article 59, Paragraph 2 of the German Basic Law, a law of approval by the Bundestag and Bundesrat before it can actually be applied. Our experience with similar agreements shows that several months, sometimes even over a year, typically pass between signing and actual application. Therefore, anyone planning to come to Germany now or to... When sending a skilled worker , the transition period should be legally sound – for example, through a correct determination of status with the German Pension Insurance or a carefully checked posting certificate.

What does this mean for employers and HR departments?

For companies that are Colombian The agreement is financially relevant for temporary assignments of skilled workers to Germany or, conversely, for sending German employees to Colombia: Double contributions to both social security systems will no longer be required for temporary assignments. Secondments . Until the new regulations actually come into force, however, the existing legal situation remains decisive, and this is precisely where most mistakes occur in practice: Employment contracts that are not prepared for the later applicability of the agreement, or Postings without proper documentation regularly lead to subsequent claims from pension insurance providers. HR departments should therefore already be checking which employees will benefit from the new regulations and preparing the relevant documents, instead of waiting.

What does the agreement mean for skilled workers and their families?

Anyone who as skilled worker with a Residence permit , one EU Blue Card or within the framework of the A chance card coming to Germany must, in any case, include... secure livelihood as well as a Proof of health insurance is required – pension entitlements do not initially play a role in the granting of the pension itself, but they are important for long-term life planning. Anyone currently working in Germany who later returns to Colombia or stays permanently wants to know whether their contributions will be lost. The agreement provides clarity on this. This also applies to family members who are part of the agreement. The new coordination of insurance periods applies to family reunification involving moving and taking up employment oneself.

Why isn't waiting or a self-application sufficient?

Many affected individuals simply wait for the law to come into effect or rely on generic information from forums and legal tech portals. The problem: the transition phase until final ratification, the specific design of the status determination procedures, and the interplay with immigration law issues. Immigration Office and The state immigration office's questions are difficult to answer in general terms. From hundreds of cases we have handled, we know that, especially with bilateral agreements of this kind, the practical application by case workers often deviates from the pure legal situation – knowledge that is not found in any commentary, but which can lead to delays of several months in individual cases.

Conclusion

The German-Colombian social security agreement is an important step towards establishing Colombia as a partner country of the German social security system. To make skilled worker immigration even more attractive and to eliminate pension disadvantages for mobile workers. However, caution is still required until actual implementation: Anyone who now The company plans to send someone on a posting. Anyone recruiting skilled workers or planning to relocate to Germany themselves should ensure the transition phase is legally sound, rather than relying on uncertain self-declarations.
