The year 2025 was particularly dynamic for VISAGUARD and the entire migration landscape in Germany . Numerous new developments, political decisions, and legal debates shaped the field. On a professional level, the focus was primarily on the abolition of so-called "turbo naturalization" (including corresponding "last-minute cases") and the heated discussions surrounding the "Work and Stay Agency" (WSA) . These debates illustrate how sensitive and complex the issue of naturalization and residency rights remains. At the same time, we were also concerned with the ongoing challenges posed by the European Entry/Exit System (EES) , stricter visa requirements, particularly for Russian nationals , and the so-called " IU cases ."
Perennial issues: Inaction lawsuit and fictitious certificates
Particularly relevant in 2025 were perennial issues such as inaction lawsuits in naturalization proceedings , which repeatedly highlight bureaucratic hurdles and delays. The issue of legal action to obtain fictitious residence permits under Section 123 of the Residence Act was also widely discussed. At the administrative level, cases of corruption in Munich and controversial scandals such as " Love in the LEA " (State Reception Center) significantly shaped the year. In the court system, isolated xenophobic statements in Gera and the abolition of the remonstration procedure made headlines. In the area of visa litigation, legal victories against unlawful border controls and broken promises regarding visa applications were particularly noteworthy.
Legal proceedings at VISAGUARD 2025
For our law firm, 2025 was an intense year filled with litigation . Whether naturalization, visa law, or residency issues – we successfully supported many clients and handled numerous cases. We focused particularly on actions for failure to act , appeals against visa rejections , and preliminary injunctions for the issuance of deemed residence permits. The growing number of cases clearly reflects the increasing demand for professional legal support in migration practice.
In addition to our professional work in the courtroom, we supported our clients with sound advice and comprehensive assistance. Direct communication and the trust placed in us were more important this year than ever.
Technological advances: Digitization and new tools 2025
Significant progress was also made in migration law on a technical level in 2025. The Berlin State Office for Immigration massively expanded its online application options , and these systems now finally function (relatively) reliably. Great strides were also made in the visa sector: the new international portal allows applicants to complete their processes much more easily and quickly online. At the same time, the EU introduced the Digital Entry/Exit System (EES), which modernizes and standardizes the control and management of entries and exits. For 2026, digitalization is expected to gain even more momentum , particularly in connection with the planned introduction of the Work and Stay Agency. New digital services and interfaces will enable more efficient application and management of work stays.
