Glossary: Extension of residence permit

Category: Visa & Residence Permits (Residence permit as long-term residence permit according to § 4 para. 1 sentence 2 no. 2 AufenthG )

The image shows an official/formal legal template of a residence permit/eAT ("electronic residence permit") in the form of a plastic card. The plastic card is the physical document with which foreigners prove their residence status in Germany.

Under “Remarks” (or on the supplementary sheet ), the purpose of the stay, including the relevant section (§), must be entered for (extended) residence permits . Under “Remarks” it must also be entered whether gainful employment is permitted or not ( § 4a para. 3 sentence 1 of the German Residence Act ). Furthermore, the substantive validity period of the (extended) residence permit must be entered under “Remarks” if it differs from the formal validity period (e.g., due to an expiring passport (“License substantively valid until…”)). In some cases, further supplementary provisions are entered under “Remarks” at the discretion of the case worker (e.g., conditions for termination in the case of receiving social benefits).

Definition of extension of residence permit

The extension of a residence permit pursuant to Section 8 of the German Residence Act (AufenthG ) refers to the process of renewing the validity period of a temporary residence permit in order to prevent the right of residence from expiring ( Section 51 Paragraph 1 No. 1 AufenthG ). The same regulations apply to the extension of a residence permit as to its initial issuance (Section 8 Paragraph 1 AufenthG). Extending a residence permit is usually considerably simpler than issuing it for the first time. A residence permit generally cannot be extended if the competent authority has excluded this possibility at the time of issuance or the last extension of the residence permit, given that the stay is intended to be temporary (e.g., residence permits for specialty chefs , au pairs , or short-term, quota-based employment ).

Who needs an extension of their residence permit?

Every non-European foreigner (third-country national) must have their residence permit extended if it expires ( § 51 para. 1 no. 1 of the German Residence Act ) in order to continue residing in Germany ( § 4 para. 1 of the German Residence Act ). This does not apply if residence is permitted for other reasons. In particular, residence is still possible even without a granted extension of the residence permit if the extension was applied for before the expiry date of the residence permit (so-called deemed validity pursuant to §§ 81 para. 3, para. 4, para. 5 of the German Residence Act ).

Example: The wife of an Indian national who has an EU Blue Card must have her residence permit for family reunification extended at the immigration office in order to continue to stay in Germany.

Important information regarding the extension of your residence permit

Duration of the extension of the residence permit

The duration of an extension of a residence permit is determined according to the same criteria as the initial issuance of the residence permit ( § 8 para. 1 of the Residence Act ). Therefore, the duration of the residence permit must also be limited upon extension, taking into account the intended purpose of the stay ( § 7 para. 2 of the Residence Act ). The duration of the extension of the residence permit thus depends, for example, on the length of the employment contract or the duration of studies or vocational training . A residence permit for the purpose of family reunification may be granted for a maximum of the validity period of the foreigner's residence permit during which the family reunification takes place. This also applies in cases of extension.

Extension of residence permit

An extended residence permit can be extended an unlimited number of times, as long as the conditions continue to be met.

Costs of extending a residence permit

Extending a residence permit at the immigration office costs €96 (§ 45 No. 2 AufenthV). Changing the purpose of residence and subsequently issuing a new residence permit costs €98 (§ 45 No. 3 AufenthV). Legal fees, any court costs , and translation and authentication costs are not included.

Processing time for extension of residence permit

The processing time for extending a residence permit depends on the type of permit. In most cases, extending a residence permit is significantly faster than the initial issuance, as all requirements have already been checked and a file has been created. Furthermore, after two years of employment , the approval of the Federal Employment Agency is no longer required for extending the residence permit ( § 9 BeschV ), which can considerably expedite the process. Overall, the immigration office can process the residence permit extension within a few days or weeks if sufficient processing capacity is available and appointments can be scheduled. On average, in well-functioning and not overburdened offices, extending a residence permit takes approximately two to four weeks. After three months of processing time for the extension of the residence permit, an action for failure to act can be filed ( § 75 VwGO ). The processing time can be expedited if the application is well-prepared and the case worker works efficiently and effectively.

Competent authority for the extension of the residence permit

The local immigration authorities are responsible for extending residence permits ( § 71 para. 1 sentence 1 of the Residence Act ). The responsible authority for extending a residence permit is determined by the applicant's habitual residence ( § 3 para. 1 no. 3 a) of the Administrative Procedure Act ). This is usually their place of residence. The responsible immigration authority can be determined using the BAMF-NAvI database .

Rights and options regarding extended residence permits

Work permit; extension of residence permit

Foreign nationals with an extended residence permit are allowed to work unless a law or the supplementary provision under "Remarks" specifies a prohibition ( § 4a para. 1 of the German Residence Act ). As a general rule, residence permits for employment ( §§ 18 et seq. of the German Residence Act ) generally permit work for a specific employer , residence permits for family reunification ( §§ 27 et seq. of the German Residence Act ) permit any employment (including self-employment), and residence permits for education / studies ( §§ 16 et seq. of the German Residence Act ) permit work only to a very limited extent or not at all. However, the specifics usually depend on the type of residence permit and the supplementary provision issued by the authorities regarding the work permit.

Studies , school , language course , extension of residence permit

Attending university, school, and language courses is possible with any residence permit and any extended residence permit . Unlike a work permit, no separate permit is required for this.

Family reunification ; extension of residence permit

Family reunification with the holder of an extended residence permit is generally always possible ( § 29 para. 1 no. 1 of the German Residence Act ). However, this depends on the type of family reunification and the type of residence permit . Spousal reunification is always possible if the residence permit has been valid for at least two years ( § 30 para. 1 sentence 1 no. 3 d) of the German Residence Act ) or if the marriage already existed when the residence permit was granted (§ 30 para. 1 sentence 1 no. 3 e) of the German Residence Act). For numerous residence permits (especially for work purposes), there are exceptions to this rule. The reunification of minor children with the holder of a residence permit is almost always possible (see § 32 of the German Residence Act ). Family reunification with the holder of a residence permit is only possible for skilled workers ( § 36 para. 3 AufenthG ) or in cases of particular hardship ( § 36 para. 2 AufenthG ) if the child is already of legal age.

Travel and stays abroad: Extension of residence permit

Entry to and exit from Germany is straightforward with an extended residence permit , as long as the permit is valid . A certificate of deemed residence is required for travel with an expired residence permit. Stays abroad of up to six months are permitted with this residence permit ( § 51 para. 1 no. 7 of the German Residence Act ). However, the residence permit expires even before the six-month period if the departure is for a non-temporary reason (§ 51 para. 1 no. 6 of the German Residence Act). The strongest indication of a non-temporary reason for departure is the deregistration of one's residence (so-called registration gap).

Eligible group of persons for extension of residence permit

All non-European foreigners (third-country nationals) who hold a residence permit ( § 8 of the German Residence Act ) and whose residence permit expires within the next three months due to the passage of time pursuant to § 51 para. 1 no. 1 of the German Residence Act are entitled to an extension of their residence permit. The same regulations apply to the extension of the residence permit as to its issuance (§ 8 para. 1 of the German Residence Act). As a rule, the residence permit cannot be extended if the competent authority has excluded this at the time of issuance or the last extension of the residence permit, given that the stay was intended to be only temporary (§ 8 para. 2 of the German Residence Act).

Requirements for extending a residence permit

The same regulations apply to the extension of a residence permit as to its initial issuance ( § 8 para. 1 of the Residence Act ). Therefore, the same requirements must be met for an extension as for the initial issuance of a residence permit. However, the following additional requirements apply to the extension of a residence permit: that the issuing authority has not excluded the extension in the supplementary provisions (§ 8 para. 2 of the Residence Act) and that the foreigner has complied with any obligation to properly participate in an integration course (§ 8 para. 3 of the Residence Act). In practice, however, the obligation to participate in an integration course for the extension of a residence permit is rare.

Accordingly, the requirements for extending a residence permit are as follows:

  1. Extension is not excluded by the immigration authorities by way of a supplementary provision on the grounds of only temporary residence ( § 8 para. 2 AufenthG )

  2. A foreigner has completed an integration course if he has been required to do so by the immigration authorities (§ 8 para. 3 AufenthG)

  3. All special requirements for the granting of the residence permit are still met (§ 8 para. 1 AufenthG; e.g., in the case of a residence permit for work, the employment contract remains in effect, or in the case of a residence permit for family reunification , the marriage remains in effect).

  4. All general requirements for the granting of a residence permit are still met (§ 8 para. 1 AufenthG; in particular passport not expired and no criminal offense committed in the meantime)


No ongoing investigations/no pending criminal proceedings against the applicant (see Section 79 Paragraph 2 of the Residence Act )

Required documents for extending a residence permit

The documents required for extending a residence permit are, in most cases, the same or largely the same as those required for the initial application, as the same regulations apply to extensions as to initial issuance ( § 8 para. 1 of the German Residence Act ). Accordingly, the necessary documents for extending a residence permit depend primarily on the responsible immigration authority and the type of residence permit being extended. The required documents for extending a residence permit can therefore vary from authority to authority and are usually listed on the immigration authority's website. These documents are required to prove that the conditions for the residence permit continue to exist since it was granted.

It is not possible to definitively answer which documents are required for the extension of a residence permit in all cases. Contrary to a widespread misconception, the residence permit procedure is not bound to a specific form ( Administrative Court Osnabrück, decision of April 24, 2009, 5 B 29/09 ) . Nevertheless, administrative practice at the immigration authorities (which is subject to the discretion of the case workers) has shown that at least the following documents are usually required for a residence permit extension:

  1. Proof of the continued existence of the purpose of stay: e.g., extension agreement for the employment contract in the case of a work permit or certificate of enrollment for the new semester in the case of a study permit.

  2. If required by the authorities: Application form for the extension of the residence permit (if an online application is not possible (depending on the respective immigration authority))

  3. Proof of previous residence permit (copy of the residence permit previously held by the applicant)

  4. Proof of residence for the jurisdiction of the immigration authority : (if applicable, updated) registration certificate pursuant to Section 18 BMG

  5. Proof of sufficient means of subsistence (housing): Rental agreement stating the size of the apartment and proof of payment of rent (e.g. bank statements)

  6. Proof of sufficient means of subsistence ( health insurance ): (if applicable, updated) health insurance certificate and, if requested by the case worker, also a description of benefits and confirmation of sufficient scope of health insurance benefits from BaFin.

  7. Proof of sufficient means of subsistence ( financial resources for daily needs ): Screenshot of bank statement or confirmation from the bank regarding assets

  8. Other formalities:


Generally, submitting your passport and entry visa again is not required, as these documents are already on file with your immigration authority when applying for an extension of your residence permit . However, some immigration offices still require these documents to be submitted again, even though this is unnecessary.

Advantages of extending a residence permit

  • Staying in Germany and entering Germany is still possible.

  • Working and being self-employed in Germany is possible if the conditions continue to be met.

  • All the benefits of the original residence permit.

From extended residence permit to permanent residence permit

In some cases, instead of extending a residence permit, a settlement permit can be applied for if all the requirements for applying for a settlement permit are met (see Section 9 of the Residence Act ). However, this depends on which residence permit is to be extended, as not all residence permits entitle the holder to conversion into a settlement permit.

From extended residence permit to naturalization

Naturalization is generally possible with an extended residence permit (see Section 10 Paragraph 1 Sentence 1 No. 2 of the German Nationality Act ), provided the other requirements for naturalization are met. However, this depends on the type of extended residence permit. Some residence permits do not entitle the holder to naturalization but must first be converted into a settlement permit . The following residence permits do not entitle the holder to naturalization (see Section 10 Paragraph 1 Sentence 1 No. 2 of the German Nationality Act ):

Contrary to a widespread misconception, holding a residence permit that does not entitle one to naturalization does not mean that the time spent with that permit does not count towards the naturalization period . This time does count; it simply means that a change to a different residence permit (e.g., a permanent residence permit ) is required before naturalization can take place.

Legal basis for residence permit

The legal basis for the residence permit is Section 7 of the Residence Act (general legal basis). The legal basis according to Section 7 of the Residence Act is then supplemented (“in conjunction with (iVm)”) by the specific legal basis (e.g., Section 16b of the Residence Act for the residence permit for study purposes , Section 18b of the Residence Act for the residence permit for academic professionals , Section 18d of the Residence Act for the residence permit for researchers , or Section 30 of the Residence Act as the legal basis for the residence permit for family reunification ).

What do I need to do to extend my residence permit?

Extending a residence permit works essentially the same way as the initial issuance. The exact procedure depends on which immigration office you apply to. Most larger immigration offices offer the option to apply for an extension online. If this is not the case with your office, you will need to schedule an appointment. Legally, you can also apply for an extension by email or mail. Once the extension application has been submitted correctly, your residence is generally considered legal until the authorities make a decision, even if the old document expires in the meantime (so-called continued validity fiction according to Section 81 Paragraph 4 of the German Residence Act). In this case, the authorities often issue a certificate confirming the continued validity of the permit (Section 81 Paragraph 5 of the German Residence Act).


How can I extend my residence permit in Germany?

Extending a residence permit requires an application to the local immigration office, which generally works the same way as the initial application. Depending on the city, this application can be submitted in person during an appointment, by mail, or via an online portal. Legally, applications can also be submitted by mail or email. It is advisable to check the website of the respective city administration beforehand for the exact procedure, as processes can vary slightly between municipalities.

What documents are required to extend a residence permit?

For the renewal of a residence permit, almost identical documents are usually required as for the initial issuance. However, most of these documents are often already on file in the immigration file, so only updated documents need to be submitted (e.g., renewal of an employment contract, new pay slips, new passport (if a new one has been applied for), new registration certificate, and rental agreement (if a move has occurred)). Immigration authorities often also require proof of rent payments for the past few months. Students are frequently required to provide a new certificate of enrollment.


When is the residence permit not extended?

An extension is generally refused if the basic requirements for the respective purpose of residence are no longer met, for example, if studies have been discontinued or employment has been lost without a new position being found. A threat to public safety, such as serious crimes committed in the interim, can also lead to refusal. In practice, however, the refusal of an extension application is significantly less common than the refusal of an initial application.
